Divorce in Arizona

Arizona couples wishing to dissolve their marriage have several options.  The three most common options are:

  • Contested Divorce – which means the couple cannot come to an agreement on one or more issues such as division of property/assets, child custody, visitation schedules/rights, alimony, and child support.
  • Uncontested Divorce – once a spouse has filed a request or petition stating they wish to dissolve their marriage, and the other spouse simply does not contest it by making a response, the court can issue a default judgment dissolving the marriage.  If both spouses agree to end their marriage and also agree upon division of property, child custody, child support, alimony, etc., they can submit a Marital Settlement Agreement/Consent Decree.
  • Arizona divorce law also allows a spouse to request a court order for mediation that takes place prior to the actual divorce filing, and may involve an attempt to conciliate the marriage, or to avoid a court proceeding dissolving the marriage by reaching an agreement regarding division of assets, child custody, etc.  Mediation also allows a spouse who wishes to reconcile the opportunity to have a conciliation conference attended by both spouses whereby an attempt is made at a resolution that will avoid a divorce.

Child Custody and Family Law in Phoenix

Marriages ending in divorce are seldom without a high level of tension, and this tension is exacerbated when children are involved.  Not only is each parent obligated to their child or children emotionally, they also have financial obligations. Working out the financial arrangements often prove to be the most difficult decision a couple faces during this stressful event.  The Family Law attorneys at Jardine, Baker, Hickman, Houston PLLC have worked with hundreds of families to amicably resolve child custody issues and alleviate the additional stress placed upon both children and parents resulting from these disagreements.

In divorces involving child custody, the court takes into consideration what they believe is the best interest of child, including which parent may be able to provide the most stable environment for the child/children.  Parents often contest the custody decisions made by the court, including visitation schedules and rights of both the custodial and non-custodial parent.  Phoenix, Arizona, family law attorneys at Jardine, Baker, Hickman, Houston have a team of experts available to fight for your parental rights.
